Regulation requires due process by colleges and universities for accused students.
District of Columbia U.S. District Court Judge Carl Nichols has allowed a recent rule change by the Department of Education to stand that requires students accused of sexual misconduct to receive due process from the college or university they attend. The attorneys general of 17 states and the District of Columbia had made a motion to block the new regulations.
The rule in question, that went into effect this week, also narrows schools’ jurisdiction to on campus and requires accusers to be students of the college or university. The attorneys general claimed that the Department of Education was exceeding its authority by changing the regulation.
Judge Nichols wrote, “the Final Rule is rooted in the text of Title IX itself, and the Court cannot supplant the Department’s view of its own authority with Plaintiffs’ preference for a broader one.” The federal judge also noted that many schools had already updated their policies to comply with the new regulations prior to their effective date.
